Frequently asked questions

For most driving matters, you should look to:

  1. Obtain character references (we will provide you with a reference template);
  2. Undertake a driving course (we will give you referrals to courses regarded highly by the Courts); and
  3. See a drug or alcohol counsellor.

More serious offences may require you to do additional preparation. Your lawyer will also obtain your background information to draft their “submissions”. These are mitigating factors they will present to the Court on your behalf.

The first Court date is called a “first mention”. Many traffic matters can be heard and finalised on this date. You are also allowed to seek a later date to finalise your matter. If you are unavailable or require more time to prepare, you, or your lawyer, can seek an “adjournment”. You may need to ask for an adjournment at the first mention, say to undertake a driving course. There is no penalty to you for requiring more time. The Court will usually grant an adjournment on the first mention without issue.

It is helpful if you can send us anything you have received from the police or Queensland Transport.

If you have been charged, we will obtain a copy of the police document which sets our their version of events and a copy of your traffic history, and ask you to review this.

We will also request information about the offence, your background, and personal circumstances to assist us to speak to the Court and make submissions of your behalf.

If you plead guilty, you accept responsibility for the offence, and your matter is usually resolved more quickly. Your lawyer will prepare submissions to present mitigating factors to the Court, which can go toward obtaining a more lenient sentence.

If you contest the charges, you challenge the allegations. This may require a trial, where evidence is presented and witnesses can be cross-examined.

Another option that may be available, is to negotiate with Police Prosecutions about some elements of the charge outside of Court before pleading guilty.

Your lawyer will discuss the pros and cons of all approaches to help you make an informed decision.

If you’re unable to appear on your scheduled Court date, you can ask your lawyer to seek an adjournment on your behalf. In most cases, the Court will grant an adjournment. We will discuss with you if we foresee any risks with this before the Court date.
