Drug Driving and driving with relevant drug

Do you have to appear in Court for a drug driving offence?

If you are charged with driving under the influence of drugs or driving with a relevant drug in the system in Queensland, depending on which charge you are facing, you will be disqualified from holding a Queensland driving licence for minimum period of 1 or 6 months.

Drug driving tests are undertaken by roadside drug tests, usually through an oral saliva test. If you can’t provide a saliva sample for some reason, such as incapacity, then they can be conducted by a blood or urine test. To be found to be driving under the influence of a drug, it is important to know that this does not just mean illegal drugs but can be prescription drugs or other over the counter drugs from a chemist and can still face licence disqualifications, fines and imprisonment.

The roadside drug tests will test the saliva for one of three drugs being:

  1. Methylamphetamine – generally referred to as speed or ice;
  2. THC which is the active ingredient in cannabis or marijuana; and
  3. MDMA which is the active ingredient in ecstasy.

Positive test results – roadside drug test

Different drugs can stay in your system for different periods of time. For example, marijuana can stay in your system for up to 40 days. Results of the roadside drug test can come back positive even if you are not at the time affected by having illicit drugs in your system, such as having consumed marijuana 2 weeks prior to the testing.

As there is no tolerance for driving with a relevant drug in your system or drug driving, you will still face conviction for the offence even if you are not affected by the drug at the time of the test.
